Privacy notice for employees and former employees

Identity and address of the Responsible Party:

The American School Foundation, A.C. (“ASF” or the “School”), with address at 215 Bondojito St., Las Americas, Álvaro Obregón, 01120, Mexico City.

Categories of the data treated by the School:

As part of your registration as an employee, the School will collect and process the following data:

  1. Identification: full name, place and date of birth, age, CURP, RFC, electronic signature, social security number, marital status and image (photograph and video).

  2. Contact: address, e-mail and telephone, as well as the same data of dependents and beneficiaries and who will be contacted for emergencies

  3. Professional: Occupation, position, area or department, extracurricular activities, work references, personal references, academic history, performance history, address, e-mail and telephone of last work centers.

  4. Patrimonial: Bonus, salary withholdings, credit history, income and expenses, bank accounts, insurance, AFORE, bonds, credits for movable property and real estate and loans.

Likewise, we inform you that in order to comply with the purposes described in this Privacy Notice, ASF will collect and process the following sensitive data:

  1. Health data

  2. Union membership

  3. Biometric data

Purpose of the data processing:

ASF will process your data for the following purposes necessary to fulfill with the following obligations:

  1. Primary purposes:

  • Validate your identity.

  • Create a profile and register him/her as an employee or register him/her in the database of former employees.

  • Grant access to the School facilities.

  • Issue credentials and create a user profile in Facial Recognition for access to ASF facilities.

  • To carry out all the activities necessary for the administration and management of its work position and other labor benefits.

  • To carry out socioeconomic studies;

  • The administration of the electronic access to the systems and technological infrastructure of the School;

  • The administration of payroll services;

  • The administration of professional performance tools;

  • The administration and operation of the internal platform for complaints and reports to verify compliance with labor obligations, prevention of unlawful conduct, guarantee internal security, conduct investigations and, if necessary, report to the competent authorities in accordance with the applicable legal provisions;

  • The creation and implementation of analytical and statistical processes;

  • Compliance with the provisions of the employment contract that you sign with the School;

  • Manage, verify and carry out analyses or reviews in order to ensure safety within the workplace, the correct use of work tools, including computer systems, networks, e-mail, Internet, cell phone, as well as the confidentiality of information. For these purposes, the School may have access to and monitor the devices and tools that have been granted as work tools, as well as the security and CCTV systems;

  • Granting, administration, collection and procurement of payroll credits;

  • Contacting your family members, indicated by you in the employment application in case of emergency;

  • Managing and conducting evaluations, conduct, performance and capability reviews, which may include making recordings during the performance of your duties;

  • Administering health and welfare monitoring programs and pension plan programs, if you have enrolled in them;

  • The administration and coordination of events and affinity groups organized by the School, if you have enrolled in them;

  • To make audio and video recordings of the classes that you give through technological platforms to evaluate your professional performance and clarify any situation regarding the academic performance of the students. And to use such recordings as School material for future classes;

  • To provide him/her with individual and institutional training before the Secretary of Labor and Civil Protection;

  • To contact you for any matter related to the Employment Relationship or this Privacy Notice;

  • In case of being a former employee, to give labor references with whom a recruitment process is initiated.

  • To make video surveillance recordings in and around the School facilities for the safety of the entire ASF community.

 

  1. Secondary purposes.

  • Take images of yourself, whether in photographic, video or any other similar format, for internal publications in printed and/or digital media such as the School website, the School social networks and the yearbook, as well as external media authorized by the School; 

  • Send greetings, as well as notify you of celebrations and special days.

  • Inform and invite you to other social, sports, extracurricular and other events organized by the school.

  • Invite you to participate in related fundraising activities.

  • Send information of your interest about the School.

  • Send advertising, promotional and market research information.

  • If you are a former employee, inform you of new vacancies in the School that may be of interest to you.

If you do not want your data to be processed for the secondary purposes indicated, you have the right to express your refusal for such purposes through the procedure established in this Privacy Notice, specifying the secondary purpose(s) for which you do not want us to use your data. 

If you do not express your opposition to the processing of your image (whether in photographic, video or any other similar media) for the secondary purposes mentioned, the School assumes that you have given your consent for the use of your image, in terms of the provisions of the Law on Protection of Personal Data Held by Private Parties ("Law") and Articles 17 and 19 of the Law on Civil Liability for the Protection of the Right to Privacy, Honor and Self-Image in the Federal District. You may revoke your consent for the use of your image at any time.

Transfer of the data:

ASF will transfer your data to insurance companies to provide benefits such as major medical insurance, dental insurance, vision insurance and automobile insurance and in the cases legally foreseen or by request of the competent authorities.

Procedure to refuse the processing of your data:

You may refuse the processing of your data for secondary purposes, in which we require your consent, by sending an email privacy@asf.edu.mx, which must include the following information/documentation:

  1. Name of the holder of the data and address or other means to receive our response;

  2. Official ID of the holder of the data and, if applicable, of his/her legal representative (IFE, passport, professional license).

  3. A clear and precise description of the data of which you want to refuse the processing; and

  4. The express refusal of the processing of your data.

In case you don’t refuse the processing of your data within 5 (five) business days after the acceptance of this Privacy Notice, it is understood that you consent the processing of your data regarding the secondary purposes, as well as the transfer of your data for which we require your consent.

You have the right to revoke your consent or refuse the processing of your data in case you do not express your refusal to the processing of your data prior to its delivery or its use, by following the procedure above mentioned.

Means and procedures to exercise the ARCO rights and/or revoke your consent:

You have the right to access, rectify, cancel or object (“ARCO Rights”), as well as to revoke your consent to the process of your data that owns ASF, by sending a written notice to the email privacy@asf.edu.mx which must include the following information/documentation:

  1. Name of the holder of the data and address and/or email to receive our response;

  2. Official ID of the holder of the data and, in case, of his/her legal representative (IFE, passport, professional license);

  3. A clear and precise description of the data which you want to exercise your ARCO Rights; and

  4. Any other information or documentation that allows the identification of your data.

Such a request should be made in a free form or by completing the ARCO Rights Application drafted by the School which is available at the web page www.asf.edu.mx/privacy-policy and which contains all the elements required in the paragraph above. So that the Privacy Committee of the School may attend and process your application, you must duly prove your identity, so it is necessary to fulfill all the required boxes in the ARCO Rights Application and attached copy of the corresponding documents indicated in such application form.

In case of wrong and/or inadequate information/documentation, ASF may require you the missing information/documentation to can answer your solicitation, within 5 (five) business days after the reception of your solicitation. You will have 10 (ten) business days to answer such requirements, after the day you’ve received the communication. In case you don’t answer the requirement within such a period, your solicitation will be considered as not filled.

In case a correct answer with all the necessary information/documentation to accept your ARCO rights solicitation, ASF will answer you within 20 (twenty) business days after the date of reception of your solicitation. In case of appropriate solicitation, your solicitation will be applicable within 15 (fifteen) business days after the ASF’s communication.

When you exercise your ARCO rights to access your data, such information will be shared to you thought the email you’ve indicated in your ARCO Rights Application or provided by writing at the ASF address.

Options and means to restrict the use or disclosure of your data:

You have the right to restrict the use or disclosure of your data (different than your ARCO rights or to revoke your consent), by sending an email to privacy@asf.edu.mx The requirement to validate your identity and the procedure and periods to answer your solicitation shall be by following the procedure of the section above. If your request is considered viable, the School will record it on the exclusion list for the purposes for which the exclusion list is applicable.
 

Privacy notice updates:

ASF has the right to make any amendments or updates to this Privacy Notice at any time. Such amendments will be available at the web page www.asf.edu.mx/privacy-policy We recommend you check from time to time our website to keep you informed of such updates or amendments.

Governing language:

In case of any argument issue related to this Privacy Notice, the Spanish language version must govern this Privacy Notice.
